How To Submit A Written Application/Compaint To The Banking Regulation And Supervision Agency (Bddk)?

The growing banking system in our country and the fact that almost all citizens conduct banking transactions have led to disputes. Real and legal persons have the right to apply to the BDDK for the determination of the reasons for disputes between banks and their customers and for the investigation of such disputes by the institution without resorting to the courts.

This right of application derives from the Law No. 4982 on the Right to Obtain Information and the Law No. 5411 on Banking, and in this article, we will provide information on the methods of application. Applications to the institution can be made in three ways:

  1. Complaint
  2. Electronic Complaint
  3. Application for Access to Information

1. Complaint

Complaints are written complaints regarding matters that fall within the scope of the Banking Regulation and Supervision Agency’s duties and powers, excluding matters that can be evaluated under private law provisions between banks, participation banks, other financial institutions, and third parties.

Complaint petitions must comply with strict formal requirements. In accordance with Article 4 of the Law No. 3071 on the Exercise of the Right to Petition, the petition must include the following information: Name, surname, signature, full address, and personal information. Petitions that do not include this information will not be processed under any circumstances. Complaints submitted with a complaint form containing this information will be responded to by the BDDK within 30 days in accordance with Article 7 of the Law.

2. Electronic Complaints

The Electronic Complaints System aims to receive and evaluate complaints submitted to our institution regarding individual products and services provided by banks, factoring companies, financial leasing companies, and consumer finance companies under the supervision and oversight of the BDDK, through electronic means.

As it is not possible for the BDDK to take executive decisions regarding the refund of fees and commissions that are considered to have been collected unfairly, such as card fees and file expenses, in accordance with the legislation, such requests cannot be subject to electronic complaints. Furthermore, complaints made on these issues are not processed by the Authority. Therefore, it would be useful for you to seek legal support regarding your complaint.

Complaints are submitted through the BDDK E-Complaint System.

3. Information Requests

As is known, Article 7 of the Right to Information Law states that “Information requests must relate to information or documents that are in the possession of the institutions and organizations to which the request is made or that they are required to have by virtue of their duties.” In accordance with this provision, applications requesting information held by our Institution are responded to within 15 or 30 business days, depending on the nature of the information requested, in accordance with Article 11 of the aforementioned Law.

Electronic applications are submitted through the Presidency Communication Center (CİMER).

Information requests may also be submitted in person, by mail, or by fax, and the application forms may be obtained from the BDDK.
